"A former Akron police captain convicted of killing his
ex-wife in 1997 is appealing a judge’s ruling that denied him a new
trial. An attorney for 70-year-old
Douglas Prade filed the appeal Thursday.
Prade was exonerated in 2013 after experts testified that male DNA
found on a bite mark on his slain ex-wife’s medical lab coat wasn’t his.
But an appeal by prosecutors overturned the decision and put him back
behind bars a year later. Prade attorneys had requested a new trial based on changing standards
in forensic dentistry since his first trial. But the judge ruled that
the bite mark wasn’t the only reason he was convicted and he failed to
introduce any new evidence that wasn’t already considered during his
1998 trial."
